1. Usage and Safety Guidelines:

    - The rented cart must only be operated on roads with a speed limit of 35 MPH or less.

    - Renter must obey all traffic laws and regulations while operating the cart on public roads.

    - Seatbelts must be worn by all occupants of the cart at all times.

    - The cart must be stored in a secure area, and the key should be taken with you at all times.

    - Keep the cart plugged in when not in use to maintain battery life.

    - Always return the cart in a fully charged and cleaned-out condition.

**Note: If the cart is returned uncharged or in a non-rentable status, a fee of $49.00 will be applied in addition to any other damage charges that may apply

2. Driving Restrictions:

    - Off-road and reckless driving are strictly prohibited. Driving in sandy areas can cause damage to the cart's motors.

    - Sidewalks are off-limits for cart driving.

    - Operating the cart under the influence of drugs or alcohol is strictly prohibited.

3. Parking and Responsibility:

    - Always park the cart in designated parking spaces. Renter is responsible for any parking tickets or fines incurred.

    - Drivers must be 21 years of age or older and possess a valid driver's license.

4. Inspection and Damages:

    - Before using the cart, conduct an inspection for any pre-existing damages. Report any damages to the Company to avoid liability.

    - Any damages caused by the renter must be reported immediately.

    - Renter is responsible for all damages to the cart during the rental period.

5. Weight Restriction:

    - The maximum weight capacity of each cart must not be exceeded. Exceeding weight limits can compromise the cart's safety and performance.

6. Brake and Safety Measures:

    - Never operate the cart with the parking brake engaged, as this may lead to brake damage. Customer is responsible for any damage it may cause.

7. License and Insurance:

    - All drivers must be 21 years of age or older, possess a valid driver's license, and have full coverage insurance.

8. Passenger Limits:

    - The number of passengers must not exceed the cart's designated capacity (e.g., 4 passengers for 4-passenger carts).

9. Citations and Fines:

    - Renter is solely responsible for any citations or fines associated with the rented cart during the rental period.

10. Indemnification Clause:

    - Renter hereby agrees to indemnify, defend, and hold harmless Bubba's Adventure Carts & More LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or in connection with the use of the rented golf cart.

11. Insurance Requirements:

    - Renter is required to maintain full coverage insurance during the rental period.

12. Release of Liability Clause:

    - By signing this agreement, Renter releases Bubba's Adventure Carts & More LLC from any liability for personal injury, property damage, or any other claims arising from the use of the rented golf cart.

13. No Modifications Clause:

    - Renter agrees not to make any modifications or alterations to the rented golf cart without prior written consent from Bubba's Adventure Carts & More LLC. Any unauthorized modifications may result in additional fees or penalties.

14. Weather Clause:

    - In the event of inclement weather, Renter is encouraged to take appropriate precautions to ensure the safety of the rented cart and its occupants. Bubba's Adventure Carts & More LLC shall not be liable for any damages or losses resulting from weather-related incidents.

15. Notices Clause:

    - Any notices or communications required under this agreement shall be sent in writing to the addresses provided by the parties. Notice shall be deemed effective upon receipt.

16. Governing Law Clause:

    - This agreement shall be governed by and construed in accordance with the laws of the state of Tennessee, without regard to its conflict of law principles.

17. Severability Clause:

    - If any provision of this agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

18. Entire Agreement Clause:

    - This agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings, negotiations, and representations, whether oral or written.

19. Tennessee LSV Laws:

    - The operation of the rented cart must comply with Low-Speed Vehicle (LSV) laws in the state of Tennessee. This includes adhering to any LSV-specific requirements, such as lighting, registration, and equipment.

20. Limitation of Liability:

    - The Company's liability for any claims, damages, losses, or liabilities arising from the rental shall be limited to the rental fee paid by the Renter.

21. Waiver of Consequential Damages:

    - The Company shall not be liable for any consequential, special, or indirect damages arising from the use of the rented cart.

22. Dispute Resolution:

    - Any disputes arising from this agreement shall be resolved through arbitration in accordance with the Tennessee Uniform Arbitration Act.

23. Cancellations:

- Cancellations made for ANY reason prior to seven (7) days before scheduled rental will have no service fee applied.

- Cancellations for ANY reason made within the seven (7) day window before scheduled rental up until 48-hours before the scheduled rental booking will only be refunded fifty (50) percent of their entire rental purchase amount.

- Cancellations made for ANY reason within the 48-hour window before scheduled rental up will be entitled to NO REFUNDS at all.

-WE HAVE A STRICT CANCELLATION/REFUND POLICY WITH NO EXCEPTIONS.

By moving forward with scheduling and paying for a rental, the renter acknowledges that they have read, understood, and agreed to comply with the terms and conditions outlined above and inside the Golf Cart Rental Agreement provided by Bubba's Adventure Carts & More LLC. I understand that failure to adhere to these rules may result in penalties, fines, or the termination of the rental agreement. I also agree, by e-signing, that my e-signature constitutes the same legal effect and legality of my "wet-ink" signature and I recognize, being of sound state and mind, that this agreement is legally binding, once e-signed.

The renter also agrees that by providing their phone number, they confirm that they want to receive content via text/email/call from Golf Cart Rentals LLC using any contact information that they provide. The renter also understands that Golf Cart Rentals LLC will NOT sell or divulge my information to ANY third-party entity. The renter further understands that they may OPT OUT by replying STOP to any form of communication or marketing.
